Functions

In accordance with Article 9 of our Articles of Association, the functions of this Association are as follows:

  1. To represent and defend the interests of the profession and members of this Association as well as those who receive the professional services provided by Gestores Administrativos within the territorial scope of their jurisdiction, with regard to the Government and Administration, Institutions, Courts, Entities and Individuals, legitimately entitled to be a party to all disputes affecting the professional interests of the Association, its members and the recipients of its professional services, including the power to exercise the right of petition in accordance with the Law.
  2. To organise, within the scope of its competence, the professional activity of its members, safeguarding professional ethics and dignity, as well as due respect for individuals, exercising disciplinary authority with regard to professional and collegial order.
  3. To uphold the prestige of the profession, ensuring that the professional activity of gestores administrativos offers society high quality services by promoting quality in the terms set out in article 20 of Law 17/2009, of 23 November, on free access to service activities and the exercise thereof, and, where appropriate, approving a quality charter for gestores administrativos.
  4. To promote and seek harmony and collaboration between members, avoiding unfair competition.
  5. To participate in studies, the issuance of reports, the preparation of statistics and other activities entrusted to it by Administrations, as well as any other activities related to the aims and professional competence of Gestores Administrativos either at the request of an Administration, or on its own initiative.
  6. To maintain relations with all administrative and governmental authorities within the territorial scope of its jurisdiction, signing any protocols, conventions and agreements deemed appropriate, as well as coordinating such action with that of the General Council, and, where appropriate, the Regional Council. And to cooperate with Public Administrations in order to facilitate, within its sphere of competence, the establishment of a single window for electronic and remote access to information on the procedures required to access the activity and the completion of the procedures required for this purpose, in the terms established in articles 18 and 19 of Law 17/2009, of 23 November, on free access to service activities and the exercise thereof.
  7. To comply with and enforce the rules affecting the profession, and in particular the provisions contained in the Organic Statute, in this Statute, in the Internal Rules established, and the dictates laid down in the agreements adopted by collegial bodies.
  8. To prosecute before the Courts of Justice those who fraudulently impersonate a Gestor Administrativo.
  9. To ensure effective and democratic collegial organisation, through the Governing Body, establishing committees, specialist professional sections, as well as any working and research groups considered relevant to the most effective exercise and defence of the profession and of the recipients of professional services in the territorial area covered by the Association.
  10. To establish the channelling of procedures through the Association, by means of the appropriate centralised services, with the exclusive aim of expediting such procedures, at the request of the administration, and without prejudice to Law 15/2007, of 3 July, on the Defence of Competition, requiring approval of the relevant agreement in the General Meeting.
  11. To approve the Association’s budgets and establish membership contributions.
  12. To approve the Annual Report.
    m) To intervene as mediator in disputes which, for professional reasons, are submitted by members, even in arbitration proceedings, in accordance with the provisions of the Arbitration Act 60/2003, of 23 December.
  13. To promote the continuous professional development and training of members by organising training and CPD courses.
  14. To report in administrative or judicial proceedings, when required to do so or when its intervention is envisaged in accordance with the legislation in force.
  15. To establish relationships with other professional institutions or associations, aimed at facilitating knowledge and practice of the profession.
  16. To carry out any activities in the professional interests of Association members and the recipients of their professional services, as well as the functions assigned to them by the Laws and Regulations.
  17. To respond to requests for information on members and on any firm sanctions imposed on them, as well as requests for inspections or investigations made by any competent authority of a Member State of the European Union within the terms of Law 17/2009, of 23 November, on free access to service activities and the exercise thereof, and in particular with regard to requests for information and ensuring that any checks, inspections and investigations are duly motivated and that the information obtained is used only for the purpose for which it was requested.

Applicable legislation

In accordance with Article 8 of our Articles of Association, the essential purposes of this Association are as follows:

  1. To represent the general interests of the profession, especially in its relations with Public Administrations.
  2. To order, monitor, and supervise the practice of the profession within the professional legislative framework.
  3. To defend the professional interests of the Association members.
  4. To ensure that the rights of those who receive the professional services provided by gestores administrativos are respected, within the territorial scope of the Association.

In accordance with Article 7 of our Articles of Association, the Association shall be governed by the following provisions by order of legislative rank:

  1. The Spanish Constitution.
  2. Act 30/1992 of 26 November, on the Legal Regime of Public Administrations and Common Administrative Procedure, amended by Act 4/1999 of 13 January.
  3. Act 17/2009, of 23 November, on free access to service activities and the exercise thereof.
  4. Act 10/2003, of 6 November, regulating Professional Associations in Andalusia and their Regulations approved by Decree 217/06, of 12 December.
  5. Act 2/2007, of 15 March, on Professional Societies.
  6. The Organic Statute governing the profession of the Gestor Administrativo approved by Decrees 424/1963 of 1 March, 2129/1970 of 9 July, 3598/1972 of 23 December and 606/1977 of 24 March, and Royal Decrees 1324/1979 of 4 April, 2787/1979 of 26 October, 1274/1983 of 27 April, 2886/1983 of 26 October and 2532/98 of 27 November; and the Regulation of the Practice of the Profession, approved in plenary sessions of the General Council of the Ilustres Colegios Oficiales de Gestores Administrativos of 30 September and 16 December 1999.
  7. The Statutes of the Council of Colegios Oficiales de Gestores Administrativos de Andalusia approved by Order of 21 September 2007 (BOJA, 18 October ) of Andalusia’s Regional Department of Justice and Public Administration.
